BY PURCHASING A TICKET, REGISTERING FOR, OR ATTENDING ANY EVENT HOSTED BY MODERN MOMS CLUB, LLC (“MMC” OR “THE CLUB”), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE REGISTERING ON BEHALF OF A MINOR, YOU AGREE TO THESE TERMS ON THEIR BEHALF.

1. Participation & Right to Revoke: MMC hosts social gatherings that may include dining, physical activities, and optional on-site childcare provided by independent contractors. MMC reserves the right, in its sole discretion, to revoke participation privileges or remove any individual from an event venue at any time if conduct is deemed unsafe or disruptive.

2. Assumption of Risk: You recognize and acknowledge that there are inherent risks of illness or injury (including death) associated with social gatherings, food service, alcohol consumption, and children’s play activities. You agree to assume the full risk of any illness, injury, damages, or loss, regardless of severity, that you or your child may sustain as a result of participating in any aspect of the Event.

3. Waiver & Release of Liability: To the maximum extent permitted by law, you, on behalf of yourself and your children, heirs, and personal representatives, hereby fully waive, release, and forever discharge Modern Moms Club, LLC, its members, employees, agents, contractors, and the venue owners (the “Released Parties”) from any and all liability, claims, and causes of action arising out of:

• Injuries, illness, or death sustained by you or your child.

• Loss or theft of personal property.

• The Released Parties’ own negligence, without limitation.

4. Indemnification: You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, including attorney’s fees, resulting from injuries, damages, or losses sustained by you or your child, or arising from your own conduct or the conduct of your child during the Event.

5. Alcohol Policy: For events where alcohol is permitted: (i) You certify you are at least 21 years of age; (ii) You agree to consume alcohol responsibly; (iii) You agree to arrange for safe transportation (e.g., Uber/Lyft/Designated Driver) following the Event. MMC reserves the right to refuse service to any guest for any reason.

6. Childcare & Supervision

• Parental Responsibility: Parents/guardians remain ultimately responsible for their children and for determining if childcare arrangements are appropriate for their child.

• Medical Info: You must communicate any medical conditions, allergies, or special instructions via hello@themodernmomsclub.com at least 48 hours prior to the event.

7. Medical Treatment Authorization: In an emergency, you authorize the Released Parties to secure medical treatment from licensed personnel for you or your child and agree that you are solely responsible for all costs associated with such treatment.

8. Photography & Media Release: Modern Moms Club events are documented via photography and video for marketing and social media purposes. By attending, you grant MMC an irrevocable, royalty-free license to use your likeness and/or your child’s likeness in any media or promotional materials. Participation in the event constitutes your full consent to be photographed and filmed.

9. Governing Law: These Terms shall be governed by the laws of the Commonwealth of Pennsylvania. Any dispute arising from these Terms shall be brought exclusively in the state or federal courts of Pennsylvania.

10. Digital Acceptance: You acknowledge that clicking "Purchase," "Register," or "RSVP" on the MMC website serves as the legal equivalent of your physical signature on this Waiver and Release of Liability.

Modern Moms Club reserves the right to update these Terms & Conditions at any time. Updates will be reflected by the “Last Updated” date above.
